These SMS Terms of Use ("Terms") govern the text messaging program operated by Eggers Executive Search ("we," "us," or "our"). By opting in to receive text messages from us, you agree to these Terms. Please read them carefully. These Terms work alongside our Privacy Policy.

Purpose of SMS Notifications

Our SMS notifications are designed to:

  • Remind you of your job opportunities.
  • Inform you of interview scheduling and confirmations, and provide other essential updates regarding your employment related to Eggers Executive Search.

Opt-In and Consent

By providing your phone number and opting in to our SMS notifications, you confirm that you are the owner or authorized user of the phone number provided. You consent to receive recurring automated text messages (SMS, MMS) from us regarding your job opportunities and other important notifications. Message frequency may vary, generally 1 to 5 messages per week.

Consent to receive these messages is not a condition of any purchase or of receiving our services. Opt-in is collected verbally, either in person or over the phone when you speak with our staff, and your consent is recorded at that time.

Examples of program messages:

  • Hi [Candidate Name], greetings from Eggers Executive Search. We saw your resume for the [Job Title] position and think you would be a great fit. Are you interested in learning more? Reply STOP to unsubscribe.
  • Hi [Candidate Name], this is [Recruiter Name] from Eggers Executive Search. We have received your application for the [Job Title] position and are reviewing it. Reply STOP to unsubscribe.
  • Hi [Candidate Name], this is [Recruiter Name] from Eggers Executive Search. A friendly reminder of your interview scheduled today at 2 PM. Let me know if you have any questions. Reply STOP to unsubscribe.

Participation Requirements

To participate in our SMS notifications service, you must:

  • Be 18 years of age or older.
  • Own a wireless device capable of two-way messaging.
  • Be a subscriber to a wireless service with text messaging capabilities. Please note that not all mobile carriers support this service.

Indemnification

You agree to indemnify, defend, and hold us harmless from any privacy, tort, or other claims, including claims under the TCPA or any state law equivalents, arising from your voluntary provision of a telephone number that is not owned by you and from your failure to notify us of any changes to your mobile telephone number.

Dispute Resolution and Arbitration

By using our SMS notifications service, you agree to resolve any disputes with us on an individual basis and not as part of any class or representative action. You waive your right to a trial by jury and agree that any claims will be resolved through final and binding arbitration. If you do not agree to these terms, please do not participate in the service.

Miscellaneous

You warrant and represent that you have the necessary rights, power, and authority to agree to these Terms and that your participation in this service does not violate any other contract or obligation. If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.

Changes to These Terms

We reserve the right to modify these Terms at any time. Any updates will be communicated to you via SMS or email, and your continued participation in the service constitutes acceptance of the modified terms. The "Last updated" date at the top of this page reflects the most recent revision.
